I’ve said it before, and I’ll say it again. A contract isn't just a legal document. It’s also a communication tool, that allows the parties to the agreement to understand the expectations, responsibilities, payment terms, and boundaries of the relationship.
Listen, getting the opportunity is exciting, but understanding the opportunity is essential. Don't let the excitement of getting the deal make you skip the details of the deal, because the clearer the agreement, the stronger the business relationship.
Here’s the thing.
The last thing you want to do after working so hard to build your brand, is to accidentally sign away rights that you didn’t even realize you were giving up. The most successful creators and entrepreneurs don’t simply create amazing content, or produce amazing products or services, but they also understand the business behind their creativity. Because once an agreement is signed, changing its terms can become much more difficult.
Read the agreement. Understand the agreement.
You already know that your brand is your passion. Understanding what you are signing should be part of the process. Here are some things to consider:
Are there exclusivity provisions preventing you from working with competing brands?
What happens if the campaign changes, or is canceled?
When and how will you be paid?
What rights are you giving away?
I want you to say “yes” to amazing opportunities, but I also want you to know exactly what you’re saying “yes” to because your creativity has value, your voice has value, your content, business, and services have value. Therefore, your agreements deserve just as much attention as the content and business you create. You’ve invested time, talent, and energy into growing your platform or business, and every collaboration or partnership should move your business forward, and not create unexpected obligations that limit future opportunities.
The next time a collaboration lands in your inbox, celebrate! Do a happy dance if you want.
Then, take a breath…
And contact Creative Esquire Consulting before you sign. We can review the contract for you and advise on key terms and conditions that you should take a closer look at, and also provide a negotiation strategy.
Our goal is simple: to help you understand what you’re agreeing to before you commit. We’ll help identify key provisions, explain legal language in plain English, and give you the confidence to move forward knowing you’ve made an informed decision.
I can’t wait to celebrate your next collaboration or partnership with you!
